NEWS ALERT: ENBRIDGE PIPELINE v JAMES AND KRISTA BOTSFORD

Oral Arguments in the North Dakota Supreme Court in “North Dakota Pipeline Company v James and Krista Botsford”. Enbridge Pipeline (dba NDPL) sued the Botsfords using the power of Eminent Domain to condemn their land for the proposed Sandpiper Pipeline from western North Dakota to Superior, Wisconsin. The trial court gave partial victories to each side. Both sides appeal aspects of the ruling. The case has significant precedential value for the scope of eminent domain powers vested in private corporations, and for future public policies on fossil fuels.

Oral Arguments are scheduled for 1:30pm, Wednesday, Sept. 21, 2016 in the North Dakota Supreme Court in Bismarck, North Dakota.
